EPA permitting proposal raises public-notice questions for Indiana data centers
EPA proposes removing federal minimum public-participation requirements for minor-source air permits. Indiana data centers can require air permits, but the proposal does not establish that Indiana will change its rules or that every facility qualifies.
EPA’s July 1 proposal would let state and local agencies decide whether, when and for how long to invite public participation in minor New Source Review permitting. EPA says the change would reduce administrative work without changing applicable emissions requirements. It remains a proposal, rather than an enacted change to Indiana’s permitting process.
Indiana’s environmental agency says data centers’ backup generators and cooling towers can require air permits. The permit depends on potential emissions, location and equipment capacity. IDEM currently directs residents to draft-permit notices and explains how to submit comments or request a hearing.
